Last-Minute Review of 2010 Tax Changes for Small Businesses

With just one week to go before this year's official tax filing date -- April 18 -- we at GoodBiz113 wanted to provide an overview of IRS tax changes for small-business owners and self-employed folks. If you haven't yet filed your 2010 tax return, pay heed to the following tax-law revisions. If you have filed your 2010 return and it doesn't reflect these changes, then amend it accordingly -- ASAP.

During 2010, new laws -- such as the Affordable Care Act and the Small Business Jobs Act of 2010 [SBJA] -- created or expanded deductions and credits that small businesses and self-employed individuals should consider when completing their tax returns and making business decisions in 2011.

Health Insurance Deduction Reduces Self Employment Tax
With the enactment of the Small Business Jobs Act of 2010, self-employed taxpayers who pay their own health insurance costs can now reduce their net earnings from self-employment by these costs.

Previously, the self-employed health insurance deduction was allowed only for income tax purposes. For tax year 2010, self-employed taxpayers can also reduce their net earnings from self employment subject to SE taxes on Schedule SE by the amount of self-employed health insurance deduction claimed on line 29 on Form 1040.

Taxpayers can claim the self-employed health insurance deduction if the insurance plan is established under their business, and if either of the following are true:

* They were self-employed and had a net profit for the year; or

* They received wages from an S corporation, in which the taxpayer was a more-than-two-percent shareholder.

During tax year 2008 -- the most recent year for which data is available -- the self-employed health insurance deduction was claimed on 3.6 million tax returns, reducing taxpayers’ adjusted gross incomes by $21 billion.

Small Business Health Care Tax Credit
In general, the Small Business Health Care Tax Credit is available to small employers that pay at least half of the premiums for single health insurance coverage for their employees. It is specifically targeted to help small businesses and tax-exempt organizations that primarily employ moderate- and lower-income workers.

Small businesses can claim the credit for 2010 through 2013, and for any two years after that. For tax years 2010 to 2013, the maximum credit is 35 percent of premiums paid by eligible small businesses, and 25 percent of premiums paid by eligible tax-exempt organizations.

Beginning in 2014, the maximum tax credit will increase to 50 percent of premiums paid by eligible small business employers, and 35 percent of premiums paid by eligible tax-exempt organizations.

The maximum credit goes to smaller employers -- i.e., those with 10 or fewer full-time equivalent [FTE] employees -- paying annual average wages of $25,000 or less. The credit is completely phased out for employers that have 25 or more FTEs or that pay average wages of $50,000 or more per year. Because the eligibility rules are based in part on the number of FTEs, not the number of employees, employers that use part-time workers may qualify even if they employ more than 25 individuals.

Eligible small businesses will first use Form 8941 to figure the credit, and then include the amount of the credit as part of the general business credit on its income tax return.

The IRS has developed a page on IRS.gov devoted to this credit, with answers to frequently asked questions plus explanations of the credit through various tax scenarios.

General Business Credit for Employers
The general business credits of eligible small businesses in 2010 are not subject to alternative minimum tax. The new law allows general business credits to offset both regular income tax and alternative minimum tax of eligible small businesses as described in Section 2012 of the Small Business Jobs Act.

The provision is effective for any general business credits determined in the first taxable year beginning after Dec. 31, 2009, and to any carryback of such credits. For a list of the general business credits, see Form 3800.

Small Businesses Can Benefit from Higher Expensing/Depreciation Limits
For tax years beginning in 2010 and 2011, small businesses can expense up to $500,000 of the first $2 million of certain business property placed in service during the year.

In general, businesses can choose to treat the cost of certain property as an expense and deduct it in the year the property is placed in service instead of depreciating it over several years. This property is frequently referred to as section 179 property, after the relevant section in the Internal Revenue Code.

Section 179 property is property that you acquire by purchase for use in the active conduct of your trade or business, including:

* Tangible personal property.

* Other tangible property [except buildings and their structural components] used as:

1. An integral part of manufacturing, production, or extraction or of furnishing transportation, communications, electricity, gas, water, or sewage disposal services;

2. A research facility used in connection with any of the activities in [1] above; or

3. A facility used in connection with any of the activities in [1] above for the bulk storage of fungible commodities.

* Single-purpose agricultural [livestock] or horticultural structures.

* Storage facilities [except buildings and their structural components] used in connection with distributing petroleum or any primary product of petroleum.

* Off-the-shelf computer software.

Section 179 property generally does not include land, investment property [section 212 property], property used mainly outside the United States, property used mainly to furnish lodging, and air conditioning or heating units.

The Small Business Jobs Act of 2010 increases the section 179 limitations on expensing of depreciable business assets for tax years beginning in 2010 and 2011, and expands temporarily the definition of section 179 property, for tax years beginning in 2010 and 2011, to include certain qualified real property a taxpayer elects to treat as section 179 property. Qualified real property means qualified leasehold improvement property, qualified restaurant property, and qualified retail improvement property.

The $500,000 amount provided under the new law is reduced, but not below zero, if the cost of all section 179 property placed in service by the taxpayer during the tax year exceeds $2 million.

For tax years beginning in 2012, the maximum amount is $125,000; before enactment of the 2010 tax relief legislation, it was set at $25,000.

Depreciation Limits on Business Vehicles
The total depreciation deduction -- including the section 179 expense deduction, and the 50 or 100 percent bonus depreciation -- you can take for a passenger automobile [that is not a truck or a van] you use in your business and first placed in service in 2010, is increased to $11,060. The maximum deduction you can take for a truck or van you use in your business and first placed in service in 2010, is increased to $11,160.

If you do not take any bonus depreciation for the passenger automobile, truck, or van you use in your business and first placed in service in 2010, the maximum deduction you can take for a passenger automobile is $3,060, and for a truck or van is $3,160.

50 or 100 Percent Bonus Depreciation
Generally, businesses can take a special depreciation allowance to recover part of the cost of qualified property placed in service during the tax year. The allowance applies only for the first year you place the property in service.

Businesses that acquire and place qualified property into service after Sept. 8, 2010, can now claim a depreciation allowance of 100 percent of the cost of the property. The property must be placed in service before Jan. 1, 2012 [Jan. 14, 2013, in the case of certain longer-lived and transportation property].

Businesses that acquire qualified property during 2010 on or before Sept. 8, 2010, can claim a depreciation allowance of 50 percent of the cost of the property. The property must be placed in service before Jan. 1, 2013 [Jan. 1, 2014, in the case of certain longer production period property and for certain aircraft].

The allowance is an additional deduction you can take after any section 179 deduction, and before you figure regular depreciation under MACRS for the year you place the property in service. The types of property that can be depreciated are described in the instructions to Form 4562.

Small Businesses to Use EFTPS for Deposits Beginning in 2011
The paper coupon system for Federal Tax Deposits will no longer be maintained by the Treasury Department after Dec. 31, 2010. Most businesses must now make deposits and pay federal taxes through the Electronic Federal Tax Payment System [EFTPS].

Using EFTPS to make federal tax deposits provides substantial benefits to both taxpayers and the government. EFTPS users can make tax payments 24 hours a day, seven days a week from home or the office.

Deposits can be made online with a computer, or by telephone. EFTPS also significantly reduces payment-related errors that could result in a penalty.

The system helps taxpayers schedule dates to make payments -- even when they are out of town or on vacation when a payment is due. EFTPS business users can schedule payments up to 120 days in advance of the desired payment date.

Information on EFTPS -- including how to enroll -- can be found online, or by calling EFTPS Customer Service at 1-800-555-4477.

Some businesses paying a minimal amount of tax may make their payments with the related tax return, instead of using EFTPS. More details regarding taxes required to be deposited using EFTPS, dollar thresholds and other specific requirements are described on page 2 of IRS Publication 15, [Circular E] Employer's Tax Guide.

For "one-stop-shopping" small-biz tax info, go to the IRS Small Business and Self-Employed Filing Season Central: http://1.usa.gov/f8iJSr.

If, for whatever reason, you're not able to file your tax return by midnight on Monday, April 18, then simply file Form 4868 to apply for an automatic extension. Doing so will allow you six additional months to file -- i.e., till midnight on Oct. 17, 2011.

IRS Outlines New Tax Incentives Available to Small Businesses in 2010

This week, the Internal Revenue Service [IRS] released the Tax Changes for Small Businesses fact sheet. Last year, the Small Business Jobs Act of 2010, along with the Patient Protection and Affordable Care Act, provided key tax incentives for small businesses and self-employed individuals.

The IRS fact sheet highlights 2010 tax changes and details how taxpayers claim benefits.

"Through reforms in our nation’s troubling health-care system and by providing more than $12 billion in immediate, targeted tax incentives to small businesses, the last two years have been about supporting American’s small businesses," said Sen. Mary L. Landrieu [D-La., pictured], chair of the U.S. Senate Committee on Small Business and Entrepreneurship, and a lead sponsor of the Small Business Jobs Act of 2010. "As chair of the Senate Small Business and Entrepreneurship Committee, it has been my priority to find avenues to improve our nation’s economy and put dollars back into the pockets of America’s entrepreneurs.

"With tax season upon us, the IRS is making sure taxpayers are aware of these important deductions available to them. As we convene the 112th Congress, I will continue to fight for these small businesses to ensure that they continue to receive the tax incentives they need to drive our economy."

The IRS fact sheet breaks down the tax portions of the Small Business Jobs Act of 2010 and the Patient Protection and Affordable Care Act that are available to eligible small businesses in 2010. The document details the self-employed health insurance deduction, which allows self-employed individuals to deduct their health-care costs for payroll tax purposes.

In addition, the 2010 fact sheet outlines ways for small businesses to take advantage of the Small Business Health Care Tax Credit and the General Business Credit for Employers, as well as higher expensing and depreciating limits for small businesses.

The complete fact sheet, with the tax incentives available for small businesses for the 2010 tax year, is available on the "Resources" page of the Small Business Committee website at http://sbc.senate.gov/.

Verbatim: Small Business Fuels Discourse During 2010 Midterm Election Campaigns

Periodically, GoodBiz113 puts its ear to the rail to listen to what politicos, pundits and others have recently said about small businesses and our integral role in growing the U.S. economy. Today, just eight days before the critical 2010 midterm elections, we share some views with you, our loyal readers.

* * *

"Now, I want to just say a little bit about Ron, because so much of the reason we're here is to make sure that he continues to do the outstanding work that he's doing on behalf of south Florida. They have lived here for 25 years. This is where they raised their family...

"This is where Ron helped run a small business. That's who he's been fighting for since he got to Washington -- families and small business owners -- because he's part of them, he understands them." -- President Barack Obama, on a campaign stop in South Florida to support second-term Rep. Ron Klein [D.-Fla.], who aims to beat back challenger Allen West [Miami's CBS4.com, Oct. 11]

* * *

"The Small Business Jobs Act is helping the private sector move the ball forward on job creation and economic growth... I'm pleased to see these SBA loans made to local businesses, and I expect that this law will continue to expand private-sector lending in the near term through the incentives it provides for small community lenders." -- Rep. Tim Walz [D-Minn.], teaming with Sens. Amy Klobuchar and Al Franken [D-Minn.], and Reps. Betty McCollum and Keith Ellison [D-Minn.] to announce that more than $18 million in loans will go to small businesses throughout Minnesota, helping many of them remain open and creating nearly 100 jobs [TradingMarkets.com, Oct. 11]

* * *

"Spending within our means, looking at our long-term structural deficits, supporting small businesses." -- Small-business owner-turned-Congresswoman Betsy Markey [D-Col.], summing up her top goals as she seeks a second term representing citizens of Colorado's Fourth District [Capital News Connection, Oct. 15]

* * *

"I'm working with your local leaders to provide the kinds of investments to create jobs, so you're strong again and our Main Street businesses keep their doors open." -- Three-term U.S. Senator Patty Murray [D-Wash.], who has helped secure millions of dollars to repair Howard A, Hanson Dam and replace Seattle's South Park Bridge [Seattle Times, Oct. 17]

* * *

"If Republicans in Congress have their way, the millions of women who will benefit from our small-business lending programs -- from the consumer protections in the Financial Reform bill, and from the tax cuts that have helped them through a challenging economic time -- would be left without these benefits... There is an important choice for women in this country to make about whether that is the direction they want the country to move in." -- White House Deputy Communications Director Jen Psaki [ABC News, Oct. 18]

* * *

"The President knew when he came into office that he was going to have to take immediate and bold action, or we might fall down in a hole that we could not get out of. The President takes office in January of 2009. And within 30 days, passes the Recovery Act.

"Now, in the first 100 days of the Recovery Act, that gives tax relief to more than 110 million people, cuts taxes for small business eight different times. In that 100 days, authorizes 3,000 transportation projects, starts on the path to improvement...

"And it doesn’t stop with the Recovery Act. Already this year, the President signed the HIRE Act, which gives specific incentives for companies to hire people who have been unemployed for a period of time, and gets through the Small Business Jobs Act, which brings up to 16 the number of times he cut taxes for small business, reduced the capital-gains rate to zero for anybody starting their own business or investing in a small business." -- Austan Goolsbee, chairman of the Council of Economic Advisers, during the second edition of his White House White Board [White House, Oct. 19]

* * *

"I look at the jobs issue as a step-by-step process. The Recovery Act stopped our economy from going off a cliff and saved the jobs of millions of teachers, police, firefighters, first responders and others. I also have seen firsthand how it has created private-sector jobs across Wisconsin -- whether it is building a new bridge in Medford, a water sanitation system in Wisconsin Rapids, or a senior center in Plymouth.

"The next step was the HIRE Act, which gave businesses that hired workers that had been unemployed for 60 days a tax break.

"And now we have passed the Small Business Jobs Act to free up credit, so small businesses -- responsible for the majority of job creation in our country -- can expand and create jobs.

"I want to continue these targeted efforts with a jobs tax credit, which would extend and expand the HIRE Act tax break by making any business that hires new workers, expands hours or expands payroll, eligible for a tax break. As we continue to recover from the worst recession since the Great Depression, this type of tax break will help businesses next year when they are in a better position to hire." -- U.S. Senator Russ Feingold [D-Wis.], during a Q&A interview [Telegraph-Herald Online, Oct. 21]

* * *

"I think that would be a terrible mistake... Our economy depends on a financial system in which everyone competes on a level playing field, and everyone is held to the same rules—whether you’re a big bank, a small-business owner, or a family looking to buy a house or open a credit card." -- President Barack Obama in his weekly address, warning that if Republicans take control of Congress this November, they would repeal consumer protections in the Frank-Dodd financial regulatory reform legislation, which he called "one of the most important victories" he has achieved in office. [Weekly Address, Oct. 23]

* * *

"Clark, an attorney and mother of two, is a respected legislator from St. Cloud who was first elected in 2005. Endorsed by Democratic Sen. Amy Klobuchar, Clark has been a strong advocate for small-business owners, and pushed for the development of angel investor tax credits in the state." -- Editorial endorsement of Tarryl Clark [D-Minn.], who is challenging two-term U.S. House Rep. Michelle Bachmann [R-Minn.] to represent voters in Minnesota's Sixth District [Star Tribune endorsement, Oct. 24]

* * *

"Barbara Boxer's top priority is to create jobs and turn our economy around. She is fighting to provide more loans to small businesses, provide tax breaks to the middle class, cut our deficit in half by 2013, rebuild our roads and bridges and make California the hub of the new clean-energy economy.

"With so many people out of work, it's shocking that her opponent still wants to go back to the job-killing policies of yesterday. Polices that led to 700,000 job losses a month and the crisis on Wall Street due to deregulation.

"Boxer is working hard to reverse those policies and replace them with smart, targeted initiatives that create jobs here at home -- jobs for today and tomorrow...

"Boxer knows that small businesses are the lifeblood of strong local economies. This is why she supported the Small Business Jobs Act, so that small businesses can expand and create jobs. This legislation includes a provision based on a bill authored by Boxer that would create a $30 billion small business lending fund to help community banks extend credit to small businesses.

"The legislation will help small businesses compete for large federal contracts, increase the maximum size of SBA-backed loans and reduce the fees associated with these loans. The bill also includes $12 billion in tax incentives to help small and medium-sized businesses expand and create new jobs.

"Boxer strongly supported the economic Recovery Act that will help provide nearly 65,000 small-business loans, including 9,600 loans to Californians worth $5.2 billion in lending authority. These loans will make it possible for successful small businesses to expand, hire more employees and further stimulate our local economy." -- Former San Jose Mayor Susan Hammer [1991-1998], endorsing U.S. Senator Barbara Boxer [D-Cal., pictured above with supporters] for a fourth term in the U.S. Senate [San Jose Mercury News, 10/24/2010]

President Obama Signs Small Business Jobs Act; Here's What's in It

"I’m thrilled to be here on what is an exciting day," said President Obama as he prepared to sign the Small Business Jobs and Credit Act of 2010 [H.R. 5297] this afternoon. With small-business owners who will receive tax breaks and better access to credit in the audience, the President explained to everybody why he has fought so long for it:

"Now this is important because small businesses produce most of the new jobs in this country," he noted. "They are the anchors of our Main Streets. They are part of the promise of America: the idea that, if you’ve got a dream and you’re willing to work hard, you can succeed.

"That’s what leads a worker to leave a job to become her own boss. That’s what propels a basement inventor to sell a new product, or an amateur chef to open a restaurant. It’s this promise that has drawn millions to our shores and made our economy the envy of the world."

The bill includes a series of small-business proposals that the President put forth earlier this year, and small businesses will start benefiting from the bill on Day 1. Among the many important provisions in the bill, 12 of the top benefits to small businesses are:

* Extension of Successful SBA Recovery Loan Provisions -- Immediately Supporting Loans to More 1,400 Small Businesses: With funds provided in the bill, SBA will begin funding new Recovery loans within a few days of the President’s signature, starting with the more than 1,400 businesses -- with loans totaling more than $730 million -- that are waiting in the Recovery Loan Queue. In total, the extension of these provisions provides the capacity to support $14 billion in loans to small businesses. The SBA Recovery loan provisions have already supported $30 billion in lending to over 70,000 small businesses.

* More Than Doubling of the Maximum Loan Size for the Largest SBA Programs: The bill also increases the maximum loan size for SBA loan programs which, in the coming weeks, will allow more small businesses to access more credit to allow them to expand and create new jobs. The bill will permanently raise the maximum size for SBA’s two largest loan programs -- increasing the maximum 7[a] and 504 loans from $2 million to $5 million, and the maximum 504 manufacturing-related loan from $4 million to $5.5 million. In addition, it will temporarily increase the maximum loan size for SBA Express loans from $350,000 to $1 million -- providing greater access to working capital loans that small businesses use to purchase new inventory and take on their next order, allowing them to create new jobs.

* A New $30 Billion Small Business Lending Fund: The bill would establish a new $30 billion Small Business Lending Fund which, by providing capital to small banks with incentives to increase small business lending, could support several multiples of that amount in new credit.

* An Initiative to Strengthen Innovative State Small Business Programs -- Supporting Over $15 Billion in Lending: The bill will support at least $15 billion in small-business lending through a new state Small Business Credit Initiative, strengthening state small-business programs that leverage private-sector lenders to extend additional credit -- many of which have been forced to cut back due to budget cuts.

* Eight New Small Business Tax Cuts -- Effective Today, Providing Immediate Incentives to Invest: The President had already signed into law eight small-business tax cuts. Today, he is signing into law another eight new tax cuts that go into effect immediately.

* Zero Taxes on Capital Gains from Key Small Business Investments: Under the Recovery Act, 75 percent of capital gains on key small-business investments this year were excluded from taxes. The Small Business Jobs Act temporarily puts in place for the rest of 2010 a provision called for by the President: elimination of all capital gains taxes on these investments if held for five years. Over one million small businesses are eligible to receive investments this year that, if held for five years or longer, could be completely excluded from any capital gains taxation.

* Extension and Expansion of Small Businesses’ Ability to Immediately Expense Capital Investments: The bill increases for 2010 and 2011 the amount of investments that businesses would be eligible to immediately write off to $500,000, while raising the level of investments at which the write-off phases out to $2 million. Prior to the passage of the bill, the expensing limit would have been $250,000 this year, and only $25,000 next year. This provision means that 4.5 million small businesses and individuals will be able to make new business investments today and know that they will earn a larger break on their taxes for this year.

* Extension of 50% Bonus Depreciation: The bill extends -- as the President proposed in his budget -- a Recovery Act provision for 50 percent "bonus depreciation" through 2010, providing two million businesses, large and small, with the ability to make new investments today and know they can receive a tax cut for this year by accelerating the rate at which they deduct capital expenditures.

* A New Deduction of Health Insurance Costs for Self-Employed: The bill allows two million self-employed to know that, on their taxes for this year, they can get a deduction for the cost of health insurance for themselves and their family members in calculating their self-employment taxes. This provision is estimated to provide over $1.9 billion in tax cuts for these entrepreneurs.

* Tax Relief and Simplification for Cell Phone Deductions: The bill changes rules, so that the use of cell phones can be deducted without burdensome extra documentation -- making it easier for virtually every small business in America to receive deductions that they are entitled to, beginning on their taxes for this year.

* An Increase in the Deduction for Entrepreneurs’ Start-Up Expenses: The bill temporarily increases the amount of start-up expenditures that entrepreneurs can deduct from their taxes for this year from $5,000 to $10,000 [with a phase-out threshold of $60,000 in expenditures], offering an immediate incentive for someone with a new business idea to invest in starting up a new small business today.

* A Five-Year Carryback of General Business Credits: The bill would allow certain small businesses to "carry back" their general business credits to offset five years of taxes -- providing them with a break on their taxes for this year, while also allowing these credits to offset the Alternative Minimum Tax, reducing taxes for these small businesses.

* Limitations on Penalties for Errors in Tax Reporting That Disproportionately Affect Small Business: The bill would change, beginning this year, the penalty for failing to report certain tax transactions from a fixed dollar amount -- which was criticized for imposing a disproportionately large penalty on small businesses in certain circumstances -- to a percentage of the tax benefits from the transaction.

GoodBiz113's Take: After months of stall tactics -- by too many mean-spirited, just-say-no House Republicans who don't want this country to succeed under President Obama's Administration, regardless of how logical its proposed policies are -- the Small Business Jobs and Credit Act of 2010 is finally in place. Here's to moving forward -- for current and would-be small-business owners and the greater good... Cheers!

President Obama Hails Auto Industry Successes, Calls on Senate Republican Leaders to 'Stop Holding America's Small Businesses Hostage to Politics'

In this week's address -- delivered from the General Motors automobile assembly plant in Detroit/Hamtramck, Mich. -- President Barack Obama praised the successes of the auto industry's restructuring. When his Administration decided to invest in the American car companies, some said such a move was bound to fail. But since GM and Chrysler have emerged from bankruptcy, the auto industry has added 55,000 jobs -- the strongest growth in 10 years -- and, for the first time since 2004, all three companies are operating at a profit.

The President also called on Republican leaders in the Senate to stop blocking a vote on a bill helping small businesses. Even though this bill will help the nation's recovery, and has been endorsed by groups such as the Chamber of Commerce and the National Federation of Independent Business [NFIB], the Republican Senate leadership continues to hold it hostage to politics by denying an up-or-down vote on the bill.

Louisiana Firm Retrofits Building for Hammond Bird Rehabilitation Facility

A Louisiana firm -- Pevey Construction LLC, of Ponchatoula -- has been selected to retrofit an existing building in Hammond, La., to become the new bird rehabilitation facility for the Unified Command's response efforts related to April's calamitous Deepwater Horizon oil spill. Work began on Monday, July 4, 2010, and major projects are expected to be completed in two to three weeks.

The Hammond bird rehabilitation facility, located in Tangipahoa Parish, will replace the Fort Jackson bird rehabilitation facility, in Plaquemines Parish. Hammond is outside of the three-phase hurricane evacuation zones, thereby minimizing the possibility of evacuations during the 2010 hurricane season -- which is already underway. All efforts are being made to complete the move to the Hammond facility before a hurricane requires an evacuation.

The new facility measures 30,000 square feet, and has the capacity to care for approximately 2,000 birds. It is located on an eight-acre campus with existing buildings in a quiet, nonresidential area.

The Fort Jackson facility in Buras, La., has more than met the needs of the Deepwater Horizon response efforts and the wildlife that has come into its care. That facility is located along the coast in a Category 1 hurricane evacuation zone, and could be subject to evacuation and damage from tropical storms or hurricanes. Plaquemines Parish will continue to be an important location for receiving, stabilizing, and transporting animals from impacted areas.

"The wildlife branch is grateful to Plaquemines Parish officials and residents for their assistance, and we appreciate their continued support as we move to a long-term facility outside of the hurricane evacuation area," said Rhonda Murgatroyd, owner and executive manager of Wildlife Response Services LLC, and BP's wildlife branch director. "We thank everyone in Plaquemines Parish and look forward to their continued assistance with the transportation and stabilization efforts."

While the Hammond bird rehab facility is not equipped to accept walk-in volunteers, those who wish to donate their time and expertise during the Deepwater Horizon response efforts can find opportunities online:

New Jersey, Texas Firms Take Top Prize as National Contractors of the Year; Small Businesses, Business Leaders and Government Officials Honored

A small-business contractor from New Jersey and another from Texas were named the National Prime Contractor of the Year and National Subcontractor of the Year, respectively, during a breakfast ceremony held this morning by the U.S. Small Business Administration.

The event, sponsored by Raytheon, was part of National Small Business Week 2010, held at the Mandarin Oriental Hotel in Washington, D.C.

The Small Business Prime Contractor and Small Business Subcontractor of theYear awards honor small businesses that have provided the government and private sector with outstanding goods and services, either as prime contractors or as subcontractors.

This year’s winners are:

* Small Business Prime Contractor of the Year: Anne C. O’Brien, president of Kalimex Inc., of Ocean View, N.J. This woman-owned, 8[a]-certified, small disadvantaged construction company boasts 14 years of successful project experience, plus more than $18 million in annual sales revenues. In one of those projects, Kalimex reopened the stairs to the crown in the Statue of Liberty for the first time since 9/11, ensuring visitors’ safe ascent up the famous double-helix stairway to the observation level in the statue’s crown. The National Park Service described Kalimex’s work on the Statue of Liberty as "sleek, elegant and magnificent." Another notable project for Kalimex Inc. includes exterior building renovation and masonry repairs on the Edgar Allan Poe House, located in Philadelphia, Penn., for the National Park Service; and

* Small Business Subcontractor of the Year: W.T. Gardner, founder and CEO of Savage Precision Fabrication Inc., of Wylie, Tex. Gardner founded Savage, a veteran-owned and Native American-owned firm, with $2,000 worth of tools. The company manufactures precision machine and sheet metal fabrication components -- including mechanical assemblies made of aluminum, titanium, copper, stainless steel and plastics -- to meet design specifications, and support the aerospace, military, defense and high-tech industries. It develops in-house processes -- such as heat treating, aging, Tungsten Inert Gas [TIG] and Metal Inert Gas [MIG] -- that are usually outsourced by a small business. The company has 38 employees, $4.4 million in annual sales in 2008, and is a preferred manufacturer in the aerospace and defense industry.

"Today, we celebrate the contributions of the outstanding business leaders, government officials and small businesses whose inspiring work in the federal contracting arena are creating jobs and helping lead economic recovery," said SBA Administrator Karen G. Mills [pictured].

"Contracting with small businesses is a win-win for both the government and small businesses," Mills noted. "The government gets access to the most innovative companies, and small businesses get the oxygen they need to grow and take their businesses to the next level.

"That’s why it’s so important that more than $7 billion in federal contracts have already been awarded to small businesses under the American Recovery and Reinvestment Act."

Small-business owners, corporate leaders, government officials and volunteers from across the country are in Washington, D.C., for the three-day conference, to be honored during five major award events for their achievements as America’s top entrepreneurs. The contracting awards recognize businesses and organizations for their commitment to providing contracting and subcontracting opportunities to small, women-owned and small disadvantaged businesses.

Other federal contracting awards included:

Frances Perkins Vanguard Award: Honoring government and industry for excellence in the use of women-owned small businesses as prime contractors and subcontractors.

The recipients are:

* Jim Cuff, senior vice president, Science Applications International Corporation [SAIC], of McLean, Va. [Industry Buying Activity];

* Kevin Boshears, director, Office of Small Disadvantaged Business Utilization, Department of Homeland Security, of Washington, D.C. [Federal Buying Activity]; and

* Bennie Boren, acquisition supervisor/small-business specialist, Public Works Department Gulfport, NAVFAC Southeast, of Gulfport, Miss. [Federal Procurement Official].

Gold Star Award: Recognizing the exemplary performance of federal agencies and their dedicated personnel who carry out the aggressive goals and strategic initiatives that help ensure a role for small business in the federal marketplace.

The recipient is:

* Judith P. Croxton, director of business operations, Shaw Air Force Base-20th Contracting Squadron, of Shaw AFB, S.C.

Surety Bond Award: Honoring the 16 participating surety companies and bond producers for the support they provide to small businesses who need help securing bid, payment and performance bonds.

Two prominent national surety trade associations accepted the awards on their behalf. They are:

* Ms. Lynn Schubert, president, The Surety & Fidelity Association of America; and

* Mr. Mark H. McCallum, CEO, the National Association of Surety Bond Producers.

Dwight D. Eisenhower Award for Excellence: Recognizing large prime contractors that have excelled in their use of small businesses as suppliers and subcontractors.

The recipients are:

* Richard A. Heltzel, president, Healy Tibbitts Builders Inc., of Aiea, Hawaii [Construction Category];

* Amber Janey, small business liaison officer, Rockwell Collins, of Cedar Rapids, Iowa [Manufacturing Category]; and

* Keith Joy, director of small business programs, UT-Battelle LLC/Oak Ridge National Laboratory [ORNL], of Oak Ridge, Tenn. [Research & Development Category].

The 2010 Dwight D. Eisenhower Award for Excellence-Research & Development is one of SBA's top honors. Administrator Mills praised the Department of Energy's ORNL's "hard work, innovative ideas, and dedication to [its] community" while presenting the award to Keith Joy, director of small business programs at ORNL.

Joy tasked his office with "aggressive goals" to meet the requirements of the Dwight D. Eisenhower Award. In 2010, he and his staff encouraged strong performance via an internal awards program, meetings between contractors and small businesses, and extensive outreach programs to maximize the impact of ORNL's small business programs. Joy noted that he was "very proud, humbled, and appreciative" to receive this honor on behalf of his team at ORNL.

"The President recognizes that small businesses are the building blocks of our economy," said Bill Valdez, acting director of the Department of Energy's Office of Economic Impact and Diversity. "Our office's mission is to support the innovation and growth of small businesses, and we absolutely must continue to honor their hard work."

Small Business Week featured a series of forums on innovation, exporting and social media, designed to help entrepreneurs with current, real-world issues that impact their businesses. There was also a town hall forum to discuss small-business concerns.

President Obama Proclaims National Small Business Week 2010, Highlights Small-Business Growth and Job Creation

Calling small business the backbone of the nation’s economy, President Barack Obama [pictured] stressed his Administration’s commitment "to helping small businesses drive our economy toward recovery and long-term growth" in his proclamation of the week of May 23-29 as National Small Business Week.

The President’s proclamation was issued yesterday, prior to the U.S. Small Business Administration’s 47th annual observance of National Small Business Week in Washington, D.C. [May 23-25]. The event honors the nation’s most outstanding entrepreneurs, and features the announcement of the National Small Business Person of the Year for 2010 from among the 53 state small-business winners, including the District of Columbia, Puerto Rico and Guam.

President Obama will meet with Small Business Week 2010 award winners at the White House on Tuesday, May 25.

"Small-business owners embody the spirit of entrepreneurship and strong work ethic that lie at the heart of the American dream," President Obama proclaimed. "They are the backbone of our Nation's economy, they employ tens of millions of workers, and, in the past 15 years, they have created the majority of new private-sector jobs. During Small Business Week, we reaffirm our support for America's small businesses and celebrate the proud tradition of private enterprise they represent.

"Our Nation is still emerging from one of the worst recessions in our history, and small businesses were among the hardest hit. From mom-and-pop stores to high-tech start-ups, countless small businesses have been forced to lay off employees or shut their doors entirely. In these difficult times, we must do all we can to help these firms recover from the recession and put Americans back to work. Our Government cannot guarantee a company's success, but it can help create market conditions that allow small businesses to thrive.

"My Administration is committed to helping small businesses drive our economy toward recovery and long-term growth. The American Recovery and Reinvestment Act has supported billions of dollars in loans and federal contracts for small businesses across the country. The Affordable Care Act makes it easier for small-business owners to provide health insurance to their employees, and gives entrepreneurs the security they need to innovate and take risks. We have also enacted new tax cuts and tax credits for small firms. Still, we must do more to empower these companies.

"In this year's State of the Union Address, I proposed creating a $30 billion lending fund to help increase the flow of credit to small businesses, and I call on the Congress to pass this legislation quickly. My Administration is also working to extend and enhance Small Business Administration programs that have helped small-business owners acquire loans and hire workers.

"This week, we celebrate the role of entrepreneurs and small businesses in our national life. They are the engine of our prosperity and a proud reflection of our character. A healthy small-business sector will give us vibrant communities, cutting-edge technology, and an American economy that can compete and win in the 21st century."

National Small Business Week 2010 will begin with two-and-a-half days of events in Washington, D.C., at the Mandarin Oriental Hotel, where more than 100 outstanding business owners from across the country will be recognized. In addition to the State Small Business Persons of the Year, men and women involved in disaster recovery, government contracting, small-business champions, as well as SBA partners in financial and entrepreneurial development, will be honored.

A keynote address by SBA Administrator Karen Mills will highlight Monday morning’s agenda, followed by Mills hosting a town hall meeting entitled "Small Business: Driving America’s Economy." Also featured are a series of executive panel forums on innovation, exporting and social media.

Among the featured speakers confirmed are The Honorable Janet Napolitano, Secretary of the U.S. Department of Homeland Security, and The Honorable RayLaHood, Secretary of Transportation. A list of other outstanding speakers -- including prominent business leaders, CEOs and politicos -- are listed with the week's full agenda at http://www.nationalsmallbusinessweek.com/.

Labor Department Reports That U.S. Added 162,000 Jobs in March; President Obama Tells N.C. Clean-Energy Workers, 'We Are Beginning to Turn the Corner'

This morning, the U.S. Department of Labor's Bureau of Labor Statistics reported that the nation added jobs at the fastest pace in three years last month as factories, stores, hospitals and Census 2010 all brought workers on board -- the surest sign yet that the worst employment market in a generation has finally snapped back.

The unemployment rate stayed at 9.7 percent for the third month in a row. Overall, the economy added a total of 162,000 jobs for the month, including 123,000 jobs added by the private sector -- the most since May 2007. Approximately one-third of the gains came from Census 2010, with much more to come: About 700,000 head-counters will be hired to tally the nation's population this spring.

Later, President Barack Obama travelled to Charlotte, N.C., where he visited the global headquarters of Celgard LLC, a relatively small manufacturing company that is benefiting from the Recovery Act investments towards clean energy. Celgard develops and produces specialty microporous membranes for rechargeable lithium-ion batteries, and is at the frontier of our clean-energy economy -- and the frontier of recovery.

There, the President [pictured above, with Celgard employees, executives and guests] delivered remarks about the current state of the economy and job growth, noting that the economy created 162,000 new jobs created in March, instead of losing them -- "the best news we’ve seen on the job front in more than two years."

He warned that, while the economy appears to be picking up, there is still a lot of work to be done. "Economic statistics don’t do justice to the pain and anxiety that results from unemployment," said Obama. "Lasting unemployment takes a toll on families, takes a toll on marriages, takes a toll on children. It saps the vitality of communities, especially in places that have seen factories and other anchoring businesses shut their doors. And being unable to find work -- being able to provide for your family -- that doesn’t just affect your economic security, that affects your heart and your soul. It beats you up. It’s hard.

"So we have to be mindful that today’s job numbers, while welcome, leaves us with a lot more work to do. It will take time to achieve the strong and sustained job growth that we need."

The President noted that the private sector is the "true engine of job growth in this country," and that, while the government "can’t reverse the toll of this recession overnight," it can help to spur job growth by providing incentives for companies to begin hiring again.

The President recently signed the HIRE Act, a jobs bill that provides tax cuts for businesses that hire new employees, and makes investments in clean energy and schools to encourage job creation. He talked about the Recovery Act, which made significant investments in infrastructure, helping to create private-sector jobs.

President Obama also explained that Celgard LLC received a $50 million grant through the Recovery Act to expand the facility and lead in the clean energy sector, and that this story is being repeated all over the country.

"So here’s the bottom line," said Obama. "This investment is expected to create nearly 300 jobs for this company, more than a thousand jobs for your contractors and suppliers -- and these are all jobs helping America build the batteries that will power cleaner and more efficient cars and trucks. And through investments like this one across the country, we’re already seeing an incredible transformation.

"Here’s an interesting statistic: Before the Recovery Act, before I took office, we had the capacity to make less than two percent of the world’s lithium-ion batteries -- less than two percent. In the next five years, on the trajectory that we’re now on, we’re going to be able to make 40 percent of the advanced batteries right here in the United States of America. Right here.

"So the next time somebody asks you, when you’re at the grocery store, well, what did this Recovery Act do? You can tell them, one of the things it helped do is to expand and catalyze an entire new industry, where the United States of America can gain enormous market share across the globe.

"And that’s the kind of strategy we need -- helping the private sector thrive in entirely new industries, the industries of the future. It’s a strategy that will not only create jobs in the near term, but also sustained growth and opportunity in the long run."
